Nicole Lunders, ex-wife of NASCAR driver Greg Biffle, has filed a lawsuit against his estate.
NASCAR great Greg Biffle and six others, including his wife, Cristina, and two children, Ryder and Emma, were tragically killed in a plane crash on December 18, 2025. Now Biffle’s estate is facing a lawsuit from his ex-wife.
Greg Biffle was married to Nicole Lunders for eight years. The couple shared one child, Emma, who died in the crash. She was 14.
Others on board the aircraft included NASCAR crew member Craig Wadsworth, Jack Dutton, and Jack’s father, Dennis Dutton, who was piloting the plane at the time of the crash.
In early May, the family of Dennis and Jack Dutton filed two wrongful death lawsuits totaling $15 million each against the Biffle estate.
On May 20, NASCAR reporter Bob Pockrass revealed that Greg Biffle’s ex-wife has filed a lawsuit of her own. The wrongful death lawsuit filed on behalf of her daughter, Emma, is against the Greg Biffle estate, the pilot Dennis Dutton’s estate, and GB Aviation Leasing.
In a post shared to X, Pockgrass summarized the lawsuit that included the following allegations:
-No flight plan activated/radio contact as should have been, considering the weather conditions
-Failed to turn on the generator that provided power, which impacted engine performance and eventually pilot instruments
-Should have aborted takeoff since one engine was working better than the other
-Once the generator was activated, it still tried to land when it could have stayed in the air as the instruments and engines started to work properly

The filing is the latest in a series of events that have marred the Biffle estate since the accident.
Less than a month after the tragic plane crash at Statesville Regional Airport near Charlotte, North Carolina, Greg Biffle’s home was burglarized. More than $30,000 in cash, NASCAR memorabilia, and guns are still missing.
WBTV reported that “multiple conspirators that had access to and intimate knowledge of the Biffles’ accounts” took “hundreds of thousands of dollars.”
No arrests have been made, but police have identified a person of interest.
Prior to the break-in, an unknown suspect with access to the Biffle family’s bank account attempted to cash a fraudulent check.
“There are multiple suspects over multiple states. We can’t say they’re not connected, but we’re still investigating,” authorities told WBTV.
